    It has no effect on a future Citizenship application. Remember it is a payment against unemployment insurance which is paid by your previous employer/s.
    As such it is not a burden on the state.


    Does anyone know if claiming unemployment benefits after layoff have any possible impact on a future citizenship application?

    It is employers market now, so they are jsut abusing, and this is mainly there in desi employers...

    I agree the right way for Company B was to apply for concurrent H1-B that will allow you to work part time for Company B while working full time with Company A.

    Please verify that this is indeed the case with Company B's petition.

    That's right, still AOS.

    You can renew within 120 days before the EAD expire.

    I just renewed mine and my wife. My daughter is 16 and she's AOS, but don't have EAD. I am planning to apply for her EAD next month.

    My I-485 is pending, was filed in July, 07. My PD is June, 04 (EB2 India). I-140 is approved. I have to leave the US for a year to work on an expat assignment beginning last week of December, 07. I have my EAD and AP. Also, I am on a valid H1-B until May, 2008 but will be applying for an extension until May, 2009.

    Please let me know your thoughts if it would be ok for me to leave the US for a continuous period of one year while my I-485 is pending? I plan to renter the US on H-1B and not EAD/AP.

    Also, does one need to be physically present in the US to renew EAD and AP? My EAD and AP will expire in September, 07 but will I be able to renew them when I am back in Jan,09?

    For the period I am gone, do I need to pay any taxes on my foreign-earned income if I am going to a jurisdiction with which India has a favorable tax treaty? If my I-485 is pending but I am not working in the US, I do not need to pay taxes for the income earned abroad if I do not meet the "substantial prsence test" (183 days)?

    Any thoughts will be much appreciated.

    Case received and Pending is a usual status when case is pending.

    Sometimes status still remains pending even after case is processed. Also it doesn't mean that you should receive approval since your processing date is with in normal processing time, it may take one or two months more too.

    hello experts..

    My husband and I are working on H1B visa.My husband has filed for Green card..

    Now my question is at what stage in my husdband's Green card process, will I be eligible for the visa extension
    if 6 years on H1B are over??

    None. to extend your H1 you need your own employment-based-GC process. But if you have alreayd filed I-485, you dont need an H1, you can continue working on an EAD based on his green card process.

    If I also file for the green card, I get labor cleared and just in case I lose the job.Then what options I have
    for visa extension?

    If your company is willing to continue your GC (unlikely if you lose your job there) then you can get extension while that LC is valid (labor remains valid for 180 days, during which an I-140 must be filed). If you get past I-140 approval with this company, then you can use taht I-140 for extensions as long as this company does not revoke the I-140.

    If I join another company do I have to have again labor cleared to get additional visa extension
    at the completion of 6 year?what happens to priority date,can I use earlier GC filing priority date?

    Yes, you would need to restart the labor unless the previous company gets to I-140 approved stage and is willing to not revoke it. If you get I-140 with current employer, that priority-date is yours for future GC applications also. If you dont get to I-140 approval, then the date does not carry over to the new GC application

    Yea. Thats true. I will think about it. It is possible to receive receipt in one week under normal circumstances. When I had applied for 140 (Regurlar Processing) in May before the fiasco I received receipt in 3 days.

    /12/2007: USCIS Reportedly Returning Visa Numbers to DOS

    AILA has reported that when Rep. Lofgren issued a letter to Secretary Chertoff, she also disclosed that "It has also come to my attention that USCIS began returning visa numbers to the State Depaartment as early as Thrusday, July 5, 2007." It could be the answer to our question why they are holding July filing cases and why they stopped adjudicating 485 cases for which they pull out the numbers before July 2, 2007. What a mess

    Hello, I'm Hyoung and I'm graduate student at Purdue University.

    I handed in my paperworks to extend my I-20 before more than 2 weeks ago that is expired. But recommendation reason that my academic advisor wrote was not appropriate and that was "Keep studying Ph.D". I am planning to graduate my masters in August. And I-20 is expired on May/16.

    Actually, I was notified that issue 5 working days before from ISS in my school that the reason is not appropriate and handed in a new recommendation form one day after when my I-20 expired.

    At this case, do I need to follow applying procedure for a reinstatement with application fee $300?

    I'm so depressed because I did everything that I could do to prevent this problem. But whenever I email to ISS of the school, the answer was that I should finish my masters within May/16 that is impossible for me. And Finally, they emailed me that I need to apply reinstatement now.
    If there is some tips to resolve this issue that you can tell me, could you let me know?

    You need to follow what your school's ISS is asking you to do. If your concern is the $300, and if you believe that ISS was at fault for not notifying you earlier, etc., then you can bring that up with someone at ISS and ask them to waive the fee.

    If u have valid H1 visa stamped why use AP?

    But any ways, here the deal.

    My wife recently travelled on AP she had an expired H4 visa.Port of entry atlanta.
    Here is what you need
    1) 485 reciept notice(she carried orig and copies-but nobody asked for them)
    2) AP's in original "and" couple of copies wont hurt
    3) Your passport

    The court is saying that since this is a non-binding memo; the court does not need to judge whether or not the USCIS definition of an employer employee relationship is valid or not.

    It just means that H1B petitions that have denied based on the 'control' issue can be appealed presumably. But this might only be an option for large IT companies; which is probably what the USCIS knew and planned for all along. I think the goal of the USCIS is to apply this memo selectively against the smaller Desi consultancies.

    Current Residence: Missouri

    Could someone please verify the filing addresses for a FEDEX delivery.

    EAD filing Address:
    Nebraska Service Center
    850 S. Street,
    Lincoln, NE 68508-1225

    AP filing Address:
    USCIS Nebraska Service Center
    P.O. Box 87131
    Lincoln, NE 68501-7131

    Addresses are OK, but can you send FEDEX to P.O. Box?

    I am in 6th year of my H1B. It is expiring in Aug 2011.

    Here are some details:
    - My I-140 is approved with a priority date of Aug 2006 under EB2-India.
    - I did not apply for I-485 so I do not have a EAD.
    - My wife is also on H1B which expires in Aug 2012.

    Here are my questions:
    1) If I apply for H1B extension in July 2011 under regular processing and assuming it takes 4-5 months for USCIS to process the application, can I still continue to work? For how many days can I work if visa renewal is still in processing after the visa has expired.
    2) If I get a denial of H1B extension do I become out of status from the date of denial or from the day H1B got expired?
    3) If I get a denial of H1B extension can I immediately apply for H4 as a dependent to my wife's visa without any issues?
    4) If I get a denial of H1B extension, what happens to my I-140? Is it automatically invalid?
    5) If I do convert to H4 status and my priority date becomes current can I apply for I-485?

    You cannot travel and enter US with expired AP. Please renew your AP. Stamp on AP cannot make any difference as per my knowledge. You will have your I-94 also with same time stamp.

    Hi All
    My AP document expired in NOv 2008. I traveled to India and got back in Aug 2008. The officer stamped the document and wrote paroled until Aug 2009.
    Can I travel on this document?
    Please advise.

    Hey here is a situation:

    I have over 7 years of experience in IT
    Come with a 4 year bachelor and 2 year masters from India from a non-computers background.
    Have a diploma (1 year in computers)
    few other computer certificate courses.

    I work for Fortune's Best software company as sr. software qa engineer. My company wants to go ahead filing for my GC.
    My company attorney says am not eligbile for EB2 based on the above but eligible for EB3. I am confused because I already have an EB2 being filed for future employment from a small company.

    So I kind of guessing my company attorney's want to play safe to be on EB3 rather than EB2.

    So what do u guys think that my company attorney is correct.

    My understanding is that with the above qualifications, I am eligible for EB2.
    Am I wrong????

    Why EB2 ? Isn't EB3 doing better for India than EB2.
