I see people not supporting the CIR which was suppose to be a pro Immigration bill, no matter which part of the society it was supporting. My question is Are you guys out here a Pro or an anti immigration forum?
Or are you guys out here are to fulfill their selfish dreams, stand on others to reach the top.
Can anyone answer me? I really doubt the people out here.

WSJ is already pro skilled immigration and have had numerous articles on the same and keep having it all the time.
We can write to them to give it more PR. But a lot of readers of WSJ are very anti and all the comments are littered by that stuff. As a result, not sure if someone who reads the comments as well finds the articles helpful.

i remember IV team was earlier posting messages asking members to send questions because they have enough room to accomdate those in the same week. so i think the number of question is less now. this might be one of the reason we have conference call with lawyer once in two weeks.
if they get more questions in future, they can have atleast one conference call per week or they can extend it 2-3hrs too. once we get more publicity and if our members count (and questions) are doubled or tripled, we can we have more sessions with same or different lawyer. what do you think?

What will be my options to maintain my immigration status in the following scenario:
AC21 is not filed after joining the new employer (new job since 2 months).
If the previous employer revoked the I-140.
Have the same job/role and responsibilities with my new employer.
No gap between previous and new current employer.
Status of I-140 remains approved and I-485 remains pending in USCIS website.
Should I proceed AC21 filing immediately? Is there anything need to be done in order to keep the immigration status legal?
I would really appreciate your valuable suggestions.

I mom is from Nepal and Dad from India. Marriages between India and nepal is very common in my place, as we are border state. even my brother is married to nepali citizen and we have all my maternal family in Nepal.
I was born in Nepal, but my parents never thought that getting nepali passport would matter, as we were in India. On passport and other documents my I put India as my birth place and no one ever asked for proof of birth place in India back then.
Now for GC, i would need proof of birth( which i have, but from nepal) and that doesnt match my passport.
Would it be advisable to correct my place of birth in Indian passport and all the records now? Can I have "nepal" as my place of birth in indian passport? Will be be still considered Indian citizen?
How does all this affect my GC process? Any unseen dangers/after affects/side effects. please give your suggestions.

Yes, PR visa is not extendable....Also, you dont have to apply for any PR card when you go to Canada. When you enter Canada, you will automatically be a PR starting that day and the PR will be mailed to the Canadian address you provide at the airport....Its your choice to apply for a SIN card (US equivalent of SSN card)...For this you will have to go to the nearest office to do so. Usually the landing procedure takes 2 to 3 hrs...You can return the same day...PR card is issued for 5 yrs from the date of your landing and you can stay 3 yrs out of Canada...To maintain PR status, you will have to be physically present in Canada for atleast 2 yrs..Hope it works out for you.....

Canadian Immigration officer simply told me that i am a landed immigrant now, the entry stamp and document attached to the passport are enough for me to come and go freely as long as i live in CA for 2 in every 5 years. So there is no additional advantage from giving an temporary address and getting a card.

This is regarding status, if GC or CITIZEN there should not be any problem. If its H1B visa, then it should have validity. Means H1B visa should not have expired. I heard this story from my brother in law and in fact travel agents know this and they themselves advice on this. Those with expired H1B visa cannot travel through EUROPE. So my brother in law went to India through middle east.

Pay rises are OK as long as they within range for the job classification in which you work. Only trigger point is when someone takes a drastic pay cut: usually an indicator of fraud / sham-companies.

My first term on H1 expired on June 2002. I revalidated it and the second term also got expired as of June 2004. Since I was in US only for 3 years on that H1, is it possible to revalidate it again now, even I'm not working for company A now? Company A can file for revalidation for recapturing the remaining time on H1 but you may to work with them once the H1B's gets approved..

I sumited my wife's & my I140 and I485 together in this July 2nd, 2007. I'm the primary applicant and in EB3 category. I already got receipt and the requesting for fingerprinting. If i file a divorce now does it going to have any effect on my processing?

My PD is also Aug 2005 (EB2).
My ND is Sept. 17, 2007 and RD is Aug 7, 2007.
Hopefully someone picks up my file from the dungeon and at least remembers me... :)
I am glad someone is at least looking at your file ... RFE ayaa to RFE - but at least its on someone's desk ... cheers!
Does it mean they are now looking at apps based on RD, even if PD is not current? I was current in Aug/Sep, but I didn't hear anything (as possibily for them a date closer to ND is the "date received", which for me is Oct07, although my RD is 2July07).

I recently updated my address thro AR 11 online and also submitted the SRC numbers for the 485 pending for myself and wife. I received a mail (post) stating that USCIS has received my change of address notification and they have udated the new address to my 485 application. I received two seperate letters for me and spouse. But there is no change online on LUD's to those case which are 11/4 when my fingerprinting status was updated. Does this mean USCIS has goofed the address change? I have safely filed the USCIS receipt's with me in case they create issue in future. :o

I may be wrong but I remember reading that sometime back US made rule that the h1 stamping can be done only at your home country (country of nationality). So doubel check on that.

I went online to check the status of my I-485 and it displayed me the following message
Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Document mailed to applicant.
On December 19, 2007 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service.
What does it mean? Does it mean that I-485 is approved.
Pls guide.

How many days did the response delayed?
Is the decision by USCIS being taken before the response was reached?
Or even after recieving the response USCIS has not considered the response. Did they specifically mention in the denial notice that the reason as delayed response?
I guess, this would help analyse the situation
