    No you don't have to wait for your 3 year extension to return to US. Your lawyers and company are basically trying to get your three year extension so that you can get a 3 year visa stamped in your passport. But there's nothing stopping you from returning to US at any time on your current H1b.

    For your second question - no you don't have to be present in the US to file for the extension .

    Since your Father in law is a Central Govt Employee, i believe the reason they issued a white 221g is because he may not have provided a NOC (No objection Certificate) from the govt which should state that he is just travelling to US for tourism purposes and not for job related travel. This was how i had to get my father in law to get a NOC inorder to get his stamping done. Once they saw the NOC, they granted the visa.

    Can someone let me know if we can go a PCP and take medication for INH for 9 months for a positive skin test and negative x-ray.
    Or it is a rule that we need to go only to local county health dept.

    This is what I think:
    Report your address moving even within same comunity/zip if you have not done already ASAP.
    If the address in Oregon is going to remain your permanent address then you do not need to report your stay in CA.

    I was staying in Oregon.I am working in CA for the last one month.
    My family still stays in Oregon and will continue there. We also moved to diff apt one month back in Oregon. ( In the same apt complex/zipcode)

    I will stay here in CA for couple of months.

    Can I give the present address in Oregon for all of my family members Since my family still staying there.

    Do I need to give my present address for me in CA. I may be moving to diff apts here depending on project/confort.

    I have a query related to entitlement of salary and back wages. I was laid off by a big MNC software company based in Texas in Oct 2009 . Just in span of 1 week , i was offered a position by desi consulting company starting November 1 . They started my H1 transfer process stating starting date as November 1 on LCA petition . I was told to wait until H1 receipt comes and client gives green signal to start the project.
    Even after getting the receipt on 30th November , i was never sent on project neither paid .
    I waited till 31st December and left the country on 1st Jan 2010.

    What are my rights ? Am i entitled to get the back wages as stated on LCA petition because i was never paid by employer till date ?
    What is the duration period i could get the salary ?

    Please let me know the process to get my pending salary if i am entitled to get any


    Are you trying to come back. Why didnt you try to get back the salary when you were in US?

    Hi ,

    I was working for company A and got my labor and I-140 approved and then i changed to company B. My priority date is jan 2005. Is there any way that i can continue my green card process with company A. WOuld be of great help if somone can tell me if there is any way to do it.

    company A can continue your GC process while you working for company B,Talk to company A about this.I guess company A asks you to join their company , for that you need to apply H1 transfer from B to A.It's not a big problem talk to company A first.Good Luck

    Hi everybody
    My lawyer had filed my 485 eb2 on july 2 (under july bulletin).
    Now that the bulletin has been re-instated, i am getting nervous thinking if my lawyer filed the application complete or in a hurry she missed something. Obviously, i do not think it'll be right to ask her if she filed it properly.
    Under what circumstances can the application be rejected right away even before they have issued the WAC#??

    and my 140 is pending....what happens if my lawyer forgot to attach the 140 reciept? Can they still send it back??

    Here (http://www.dphoto.us/forumphotos/showgallery.php?cat=1377) are a few pictures from my excursion to Turkey Run S P last weekend. While my camera performed better than I expected from a late-90's era 2.7MP DSLR, I didn't fare so well, coming home with far fewer "keepers" than I would have liked. My greatest problem was that I either didn't set up a tripod or failed to increase the ISO to get more DOF in many landscape shots that needed it, and frequently I also got motion blur from lack of tripod usage. This experience has taught me that for me personally, even though the D1 is 2 stops faster than Velvia, I still must slow down and use a tripod - not only to prevent blur and enable slower exposures, but also to force a slower and more thoughtful pace of composition.

    Nice edit Anders. And your version seem to be more in line with the rule of thirds too?
    Hmm, didn't quite think about that. Maybe that's why I wrote I'd like more yellow line at the top, it would push the "fork in the road" down more towards a third.

    That was an old news. Around 60000 visa's were pre-allocated to pending applications before July 2nd, 2007. I would be very surprised if the numbers are not much more than 18000 for India EB3. India used to get around 40-45 K visas per year for all EB categories before 2005 since the soft quota was introduced. All these numbers are avilable on USCIS website.

    Anyway that I can get a solid black line? It keeps preserving the opacity deficient coloring of the actual rectangle. More or less, the black line is getting the same 50% opacity as I made the rectangle. Don't want that. :P

    It is not OK for the attorney to sign the papers. But no body is going to care as long as there is signature in that column. Just keep quiet, u will be fine. Ask your attorney for a copy of your filed 485 so that if anything happens, you can sign similarly in all the correspondence.

    If yes then you should be fine but with or without original 797 and no stamping in passport it will be difficult to get into USA. Unless you have AP to get back into USA. Hope this help. Good luck for your travel tomorrow.


    Hi,

    I just checked all immigration documents and found that original I797 (H1b approval) is missing. I have a copy but not original. We are travelling to India tomorrow. Is it must that we need to have original I797 at POE or is a copy ok. Appreciate if you could please let us know about this as soon as possible.
